IMPORTANT LEGAL NOTICE: Florida Bid Radar is an independent data aggregation and alert service. We are not a government agency. You are solely responsible for independently verifying all bid deadlines, requirements, and documents directly with the issuing government authority.
1. Acceptance of Terms
By subscribing to, accessing, or using the Florida Bid Radar website (floridabidradar.com) or receiving alerts (via email, SMS, or other electronic means), you ("Subscriber", "Contractor", "You") agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must not subscribe to or use the service.
2. Nature of Service (Aggregation Only)
Florida Bid Radar operates an automated monitoring tool that scans publicly accessible municipal, county, and state procurement websites across Florida.
- The Service is an informational notification tool intended solely to alert licensed contractors to publicly available procurement notices.
- Florida Bid Radar does not prepare, submit, review, or guarantee bids or solicitations on your behalf.
- Florida Bid Radar does not act as a broker, agent, or representative in any procurement transaction.
3. Non-Affiliation with Government Entities
Florida Bid Radar is a private, independent commercial service. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with the State of Florida, the Florida Department of Business and Professional Regulation (DBPR), any Florida Board of County Commissioners, any municipal government, or any governmental agency.
4. Strict "No Reliance" & Contractor Due Diligence
You acknowledge and agree that:
- Government procurement portals frequently update, postpone, amend, or cancel solicitations without prior warning.
- Public bid data aggregated by our scan engine is provided for initial notification purposes only and may contain errors, omissions, or outdated links.
- Sole Responsibility: You are solely and exclusively responsible for independently verifying all bid documents, technical specifications, mandatory pre-bid conference schedules, submission deadlines, bonding requirements, and official addenda directly with the issuing government entity prior to taking any bidding action.
- You will not hold Florida Bid Radar liable for any missed deadlines, rejected proposals, bidding disqualifications, or lost business opportunities resulting from reliance on our notifications.
5. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
FLORIDA BID RADAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ALL PUBLIC MUNICIPAL SOLICITATIONS IN FLORIDA WILL BE CAPTURED BY OUR SCAN ENGINE.
6. Absolute Limitation of Liability (Damage Cap)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FLORIDA LAW:
- No Consequential Damages: IN NO EVENT SHALL FLORIDA BID RADAR, ITS OWNERS, OPERATORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BIDS OR CONTRACTS, OR LOSS OF BUSINESS REPUTATION, ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SERVICE.
- Liquidated Liability Cap: IN ALL CIRCUMSTANCES, THE MAXIMUM AGGREGATE LIABILITY OF FLORIDA BID RADAR TO YOU FOR ANY AND ALL CLAIMS, DISPUTES, OR CAUSES OF ACTION SHALL BE STRICTLY LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO FLORIDA BID RADAR DURING THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (I.E., \$29.00 USD OR \$79.00 USD).
7. Indemnification
You agree to defend, indemnify, and hold harmless Florida Bid Radar, its owners, operators, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) any bid submitted or work performed by you on any government contract; (c) your violation of these Terms; or (d) your violation of any applicable Florida law or regulation.
8. Subscriptions, Billing & Strict No-Refund Policy
STRICT NO-REFUND POLICY: ALL SALES ARE FINAL. DUE TO THE IMMEDIATE DIGITAL DELIVERY OF TIME-SENSITIVE PROCUREMENT INTEL AND REAL-TIME BID ALERTS, FLORIDA BID RADAR DOES NOT ISSUE REFUNDS, PRORATIONS, CREDITS, OR REIMBURSEMENTS UNDER ANY CIRCUMSTANCES.
- All Sales Are Final: Because subscribers receive immediate access to digital public tender leads, proprietary scraping algorithms, and real-time alerts upon payment, all subscription charges ($29/month or $79/month) are completely non-refundable once billed.
- No Partial-Month Refunds or Prorations: We do not offer refunds, fee reductions, or credits for partial months, unused alert days, or if you decide not to bid on any solicitations during your billing cycle.
- Self-Serve Cancellation Anytime: You may cancel your subscription at any time with 1 click directly via the Stripe Customer Portal link found on your receipts or account notices. Canceling stops all future automatic renewals. Your access will continue through the end of your current paid billing period, after which no further charges will occur.
- Chargeback Fraud Notice: Initiating an unauthorized or bad-faith payment dispute/chargeback with your bank or credit card provider for legitimately provided alert services constitutes a material breach of these Terms. Florida Bid Radar reserves the right to contest chargebacks with full server logs and notify collection agencies or credit bureaus of fraudulent dispute filings.
9. Governing Law & Mandatory Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Mandatory Individual Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered in Alachua County, Florida.
Class Action Waiver: YOU AND FLORIDA BID RADAR AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10. Modifications & Inquiries
We reserve the right to update or modify these Terms at any time. Continued use of the Service after any modifications constitutes acceptance of the revised Terms.
